The Education Law of the People’s Republic of China was enacted in 1994 and amended in 2009, 2015 and 2021 respectively. The latest revision went into effect on April 30, 2021.
The law comprises 86 articles in total. It aims to develop education and improve the quality of the Chinese people.
The key points are as follows:
- Citizens of the People’s Republic of China have the right and the obligation to receive education. All citizens, regardless of their ethnic group, race, sex, occupation, economic status or religious beliefs, will enjoy the same educational opportunities in accordance with the law. The State, in light of the characteristics and needs of different ethnic minority groups, will contribute to the development of education in regions inhabited by ethnic minority groups. The State will support and assist education for peripheral and impoverished areas and for disabled people.
- The state applies a nine-year compulsory education system. Popular governments at all levels must take various measures to guarantee access to education for children and adolescents of school age. Parents or other guardians of school-age children and adolescents, as well as social organizations and interested persons, shall have the obligation to ensure that school-age children and adolescents receive and complete compulsory education for the prescribed number of years.
- People outside the territory of China, who meet the requirements of the State and have completed the relevant procedures, can enter China to study, conduct research, participate in academic exchanges or teach in schools or other educational institutions. The State will protect your legitimate rights and interests.
- Whoever steals or falsely uses the identity of another person to obtain the admission qualification will be investigated by the educational administrative authority or other relevant administrative authorities that revoke the admission qualification and may be sanctioned between two years to five years; if you have obtained a degree certificate, academic certificate or other educational certificates, the issuing authority will revoke said certificate; if he becomes a public official, he will be removed in accordance with the law; if he violates the public security administration, the public security organ will impose sanctions on him by the public security administration in accordance with the law; and if his act constitutes a crime, he will be criminally liable in accordance with the law. When a person’s right is infringed on the basis that someone else falsely obtained their admission grade, they may request that their admission grade be reinstated.
